What is a Sexual Predator?

 

The "one is enough" sexual predator is a person who was convicted of committing any capitol, life, of first degree felony violation of chapter 794 (sexual battery) of chapter 847 ( buying, selling, transfer of custody/control of a minor for sexual purpose). The "second offense" sexual predator is a person who was convicted of a second degree felony violation of Chapters 794, 847, or 800 (Lewd/lascivious), or 827 (promotion/child sexual act), and has a previous conviction for any violation of these statutes.

What is a Sexual Offender?

 

A sex offender is an individual who has been convicted of any of the before mentioned sex offenses, with the addition of Chapter 787 (Luring, enticing a child under 12 in to structure, etc). Whereas the "predator" designation refers to persons convicted from October 1, 1993 forward, the "offender status applies to persons who have been released after October 1, 1997. Predators will always meet the offender status, and it is up to the court having jurisdiction over sentencing to designate the status of the individual.
